Terms of service
These Terms of Service apply to all purchases from, and use of, extnix.com.au and our Campbellfield showroom and installation workshop. Please read them together with our Returns, Refunds & Warranty Policy, Shipping Policy, Privacy Policy and Sale & Discount Terms, which form part of these terms.
1. About Us
This website is operated by Extreme Electronix Pty Ltd (ABN 43 126 759 742) trading as EXTNIX ("we", "us", "our"), 10/85 Cooper St, Campbellfield VIC 3061. Phone 1300 096 212 · support@extnix.com.au.
Our store is hosted on Shopify, which provides the e-commerce platform we use to sell our products and services.
2. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms, or in any of our policies, excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot be excluded. If anything in these terms is inconsistent with the ACL, the ACL prevails.
3. Orders & Acceptance
- Placing an order is an offer to buy. Your order is accepted when we dispatch it, or when we confirm a showroom pickup or installation booking.
- We may decline or cancel an order before dispatch, for example if a product is unavailable, there is a pricing or listing error, or we reasonably suspect fraud. If we do, we will notify you and refund any amount paid in full.
- We may limit quantities per customer or per order, including orders we reasonably believe are placed for resale.
4. Pricing & Payment
- All prices are in Australian Dollars (AUD) and include GST where applicable.
- Prices may change from time to time, but the price that applies to your order is the price shown at checkout when you placed it.
- If a product is listed at an obviously incorrect price because of an error, we may cancel the order and refund you in full, or contact you to offer the item at the correct price.
- We accept the payment methods shown at checkout, including card payments, PayPal, Afterpay and Zip. Buy now, pay later services are also subject to the provider's own terms.
5. Product Information & Vehicle Fitment
- We take care to describe our products accurately. Product images may be for illustration purposes and the appearance of the actual product, screen or fascia may differ slightly.
- Vehicle compatibility depends on model year, trim level, factory options and any prior modifications. Please check the compatibility information on each product page and contact us before ordering if you are unsure. Fitment responsibilities are explained in section 1 of our Returns, Refunds & Warranty Policy.
- Vehicle manufacturer names and trademarks are used only to describe compatibility. EXTNIX is an independent aftermarket supplier and is not affiliated with, sponsored by or endorsed by any vehicle manufacturer. See our Trademark Disclaimer.
6. Shipping, Returns & Warranty
Delivery is covered by our Shipping Policy. Returns, exchanges, refunds and warranty claims are covered by our Returns, Refunds & Warranty Policy. Any warranty we offer is in addition to your rights under the ACL.
7. Installation Services
- Installations at our Campbellfield workshop are by appointment only.
- Please tell us about any existing electrical faults, warning lights, accident damage or previous aftermarket modifications when booking. Before starting work, we may inspect the vehicle and will let you know if we find anything that affects the installation.
- We are not responsible for pre-existing vehicle faults, or for faults caused by previous modifications, that are not caused by our work.
- Our installation work comes with the guarantees under the ACL that services will be provided with due care and skill.
- Where you supply your own product for installation, our responsibility covers our labour only. Any fault in the product itself should be raised with the business you bought it from.
- If you need to reschedule or cancel a booking, please contact us at least 24 hours before your appointment.
8. Promotions & Discount Codes
Sale events and discount codes are subject to our Sale & Discount Terms and any specific terms shown with the promotion.
9. Using Our Website
You must not use this website for any unlawful purpose, submit false or misleading information, attempt to interfere with the website's security or operation, or copy or reproduce our content for commercial purposes without our written permission.
All content on this website, including text, images, videos, installation guides and logos, is owned by or licensed to EXTNIX and is protected by copyright and trademark law.
10. Reviews & Customer Content
If you submit a review, photo, video or other content, you confirm that it is genuine and your own, and you give us permission to display it on our website and social media. We may remove content that is unlawful, offensive or misleading. We do not remove or suppress genuine reviews because they are negative.
11. Privacy
We handle your personal information in accordance with our Privacy Policy.
12. Limitation of Liability
Subject to section 2 and to the extent permitted by law, we are not liable for any indirect or consequential loss that was not reasonably foreseeable, or for loss caused by incorrect installation by a third party, misuse of a product, or events outside our reasonable control.
Where the law allows us to limit our liability for a failure to comply with a consumer guarantee in relation to goods or services not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited to, at our option, replacing or repairing the goods (or paying the cost of doing so), or supplying the services again (or paying the cost of doing so).
13. Changes to These Terms
We may update these terms from time to time. The version published on this page when you place your order or make a booking is the version that applies to that order or booking.
14. Governing Law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria.
